Terms and Conditions for Startups

Definitions
“We” “us” or “our” means Start Me Up Careers Ltd
“You” or “your” means the client

Please read all of these terms carefully as they set out our respective rights and obligations and also our expectations of you.  By confirming the placement of one of our interns with your company, we are entitled to assume that you have read these terms and conditions and that you agree to them.

 Liability

1 You are not liable for personal injury or death of an intern that result from placement arrangements.  Liability for  this resides with Start Me Up Careers Ltd or the intern depending on circumstances, and is covered in our Terms and Conditions for Interns.

2 In the instance that a legal issue arises between you and the intern, you would be liable to resolve this. Start Me Up Careers Limited is not liable for and will not be involved in any such proceedings. We will ensure that interns and  startups sign agreements that outline behavioural expectations but any breach of the law by either party is outside of our control.

Cancellations and curtailment by the Client

1. You are expected to fulfil your commitment to an intern once a placement has been confirmed. In an instance where you have to cancel the placement, you must notify us in writing a minimum of 8 weeks before the placement start date. We are obliged to provide our interns with work experience placements so any cancellations risk reputational damage to Start Me Up. 

2. Curtailment of a placement can be requested by you  in instances where an intern’s performance or behaviour has been consistently unsatisfactory.  These instances will be dealt with in line with our disciplinary policy and an intern will be given the opportunity to improve their performance before any decision to curtail the internship is made. Any final decision on curtailment will be made by Start Me Up Careers Limited in collaboration with the startup.

Amendments and cancellations by Start Me Up Ltd

1. In very occasional circumstances, we may need to cancel internship placements. In such cases, we will inform you as soon as possible. 

2. If cancellation occurs due to circumstances beyond our control, including security threats, terrorist activity, political instability or natural disasters, we will  do our best to facilitate a remote working setup for the intern in a different destination to enable the placement to go ahead.

3. We reserve the right to remove an intern from their placement in cases of performance or where we judge the physical or mental health of the intern to be at risk by continuing to work. Additionally, in any cases of family emergency our interns are free to withdraw from the placement.

 Complaints

1. We are here to help you, and our staff will do their very best to provide the highest level of service. However, a formal procedure for complaints is set out below.
2. We are providing you with a opportunity to benefit from the work of high quality candidates at no cost. We expect that you will perform a management role, including providing the structure and guidance required for the intern to complete their tasks and dealing with any issues or requests for support in a timely manner. However, if you have any problems that you find difficult to deal with, or which you feel should be our responsibility to resolve, you should follow this procedure:

a) Talk to the Start Me Up team member responsible for your intern and he or she will do their best to help you.

b) If you are unhappy with the immediate response, or you feel the time taken to resolve the problem is too great, you should present your complaint to the Country Coordinator in writing.

c) If you are still unhappy with the response to your complaint, you should put it in writing to our head office as soon as possible.

3. The above procedure exists to enable us to identify and deal with problems and complaints as quickly and efficiently as possible. Failure to follow this procedure may compromise our ability to help you. We will not be responsible for problems or complaints not brought to our attention as above.

Your responsibility and rights

1. You agree to fulfil your commitment to provide an internship placement and provide approximately 35 hours of work a week for your intern, taking into consideration their learning goals.  

2. You are expected to communicate on a daily basis with your intern and have a weekly call or meeting. We reserve the right to charge you a penalty fee of up to $500 if you fail to uphold your side of the agreement. 

You are expected to provide your intern with access to all the necessary resources, information and software required to complete the tasks you set. All interns agree not to share or keep any sensitive or confidential company information.

3. The internship is an unpaid work experience placement. You are not expected or allowed to provide compensation to your intern during their placement. Any arrangements after the last day of the placement are made exclusively between you and the intern and are no longer bound by these terms and conditions or signed agreements.

4. Start Me Up Careers Limited is responsible for providing the intern with out of hours or emergency support relating to well-being. This is not your responsibility and there is no expectation that you will fulfil this role.
5. Any Start Me Up intern agrees to be bound by your rules, regulations and policies.
6. You reserve the right to refer any event of behaviour which gives offence to you or your team to the Start Me Up Careers Limited team to be dealt with in line with our disciplinary procedure. This includes behaviour such as serious rowdiness or drunkenness, failure to turn up to work, or leaving work without any adequate reason, or in the event of an unreasonable inability, from whatever cause, to do the work expected. Please refer to the “Gross Misconduct” and “Disciplinary” sections of the Start Me Up Participant Policy for full details.
7. Any problem that arises with the intern that we consider serious will be brought to your attention in writing.
8. It is at Start Me Up’s discretion to suspend interns from their placements.
9. Proper Law and Jurisdiction – The proper law of the contract between us is English Law. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute which may arise out of or in connection with the contract.

Personal Data, And Image Rights

1 We will need to collect certain information such as your name and company details in order to arrange an intern placement. For the Purposes of the Data Protection Act 1998, we are a data controller. We may pass this information to prospective and confirmed interns. If requested to on legal grounds, we may pass this information to public authorities.

2 By confirming a placement with one of our interns you acknowledge that we have the right to use your company logo for use in our marketing, or advertising material.. If you do not wish for use to use any such images you should contact us at info@startmeup.careers

Accuracy

1. The information contained on our website and in our other advertising material is believed correct to the best of our knowledge at the time of printing or publication. However, errors may occasionally occur and information may subsequently change. You must therefore ensure you check all details of your chosen placement (including the price) with us at the time of booking.
